Datamann Privacy Procedures
- Datamann has always taken privacy seriously. We have a longstanding practice of undertaking internal privacy assessments of our products and of adopting a “privacy by design” approach to product development. While we are always reviewing our existing privacy practices and security safeguards, we believe them to be robust and appropriate for the types of data we maintain on behalf of ourselves and our clients.
- All Datamann employees have signed a non-disclosure and confidentiality agreement regarding access to customer data, and employees with access to customer data are required to go through background checks.
- Datamann has longstanding technical and organizational safeguards, appropriate for client data, in place. Datamann also has a network security policy. Some of Datamann’s technical and organizational safeguards include:
- Information security policy: Datamann maintains a written information security policy that specifies the security standards it applies to protect the personal data it processes. The information security policy mandates the use of appropriate technical and organizational security measures to protect personal data against unauthorized and unlawful processing and against accidental loss, damage or destruction.
- Physical security: Access to data processing facilities, including our data center, offices, rooms and facilities is restricted to duly authorized who have access through a numeric keypad entry system.
- Firewall and anti-virus: Datamann has implemented appropriate firewall, anti-virus, anti-spyware and other anti-malware software and technologies on all networks and systems it uses to process personal data.
- Access controls: Datamann has implemented technical access controls that restrict access to personal data it processes to duly authorized employees only.
- Usernames / passwords: Access to personal data will be controlled through access privileges, usernames and confidential passwords.
- Back-up: Datamann takes regular back-ups of the personal data that it processes.
- In addition, Datamann monitors its servers 24-hours/day as a measure to prevent against unauthorized access to client data.
Datamann Data Collection
Datamann’s web server automatically recognizes and collects only visitor’s to our website domain name, and not the e-mail address (where possible). Datamann collects the following from visitors to our website:
- e-mail addresses and/or telephone numbers of those who communicate with us via e-mail;
- aggregated information on which web pages are accessed/visited;
- information volunteered by the visitor, such as survey information and/or site registrations.
The online information/data which Datamann collects is used for:
- internal review to improve the content of our website;
- contact visitors for marketing of Datamann services and products; and
- respond to and process service requests by our clients and customers for Datamann products and services.
All marketing efforts we undertake are targeted toward a business audience only.
Datamann also receives data from its clients, which it processes on their behalf. Such data may include:
- Name and postal address, email address and/or telephone numbers of our clients’ customers;
- Transactional data related to purchases of products/services from our clients;
- Files of names and addresses previously mailed/contacted by our clients; and
- Demographic data pertaining to our clients’ customers.
Data that Datamann receives from its clients is used for:
- Mailing of postal marketing materials such as catalogs, postcards, and brochures;
- Analyzing the performance of client marketing activities;
- Determining to which customers marketing promotions should be sent; and
- Suppressing from client marketing activities all customers and consumers that have requested not to receive said promotional pieces from clients.
Datamann Data Removal
Any person or company that no longer wishes to receive telephone calls, emails, or direct mail from Datamann may request to be removed from our internal marketing list by contacting Datamann at the address, email or telephone number at the top of this page.
Datamann Data Privacy Framework (DPF) Compliance
Datamann complies with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union (“EU”) and the United Kingdom (UK) to the United States. Datamann has certified to the U.S. Department of Commerce that it adheres to the DPF Principles. If there is any conflict between the terms in this privacy policy and the DPF Principles, the DPF shall govern. DPF Complaint Resolution for Individuals from European Union Countries and the United Kingdom
In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, Datamann commits to resolve complaints about our collection or use of your personal information. EU or UK individuals with inquiries or complaints regarding our DPF policy
should first contact our Privacy Director at: privacy@datamann.com.
Datamann has further committed to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF to the ANA DPF Dispute Resolution, an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit the ANA DPF Dispute Resolution for more information or to file a complaint. Datamann Third Party Disclosure
Datamann does not compile, buy, sell, rent or trade data compiled from user activity on our website, or from our clients. However, we do submit data to several companies, licensed by the United States Postal Service, for postal address hygiene and correction. These companies correct postal addresses prior to mailings, and return the data to Datamann.
Data that we process on behalf of our clients may be disclosed to third parties, as instructed by our clients.
The Right of EU Consumers to Access Their Personal Data and Exercise Choice
Any individual may request a copy of the data which Datamann maintains on them. EU individuals may also have the right to correct or amend their Personal Data that is inaccurate or has been processed in violation of the Privacy Shield Principles, or to request that Datamann not disclose personal data to third parties, to the extent allowed by law. As previously stated, any person or company that no longer wishes to receive telephone calls, emails, or direct mail from Datamann or from a Datamann client, or who wishes to limit the use and disclosure of data, may request to be removed from our internal marketing list by contacting Datamann at the address, email or telephone number at the top of this page.
Disclosure of Personal Data to Law Enforcement
In certain situations, Datamann may be required to disclose data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
Liability for Onward Transfer
Datamann is responsible for processing the data it receives or, where applicable, transfers to a third party acting as an agent on its behalf. Datamann complies with the Privacy Shield Principles for all onward transfers of personal information from the EU, including the onward transfer liability provisions.
